These Terms of Service ("Terms") govern your use of Patch ("the app", "we", "us"). By using the app you agree to these Terms. If you do not agree, please do not use the app.

1. What Patch is

Patch is a tool that uses AI to analyze photos of your lawn and suggest possible problems and products. It is intended for informational purposes only. It is not a substitute for advice from a licensed agronomist, arborist, or pesticide professional. You are responsible for any product you choose to apply to your lawn, including following the product label and local laws.

2. No warranty on diagnoses

Diagnoses are AI-generated and may be wrong. Always read the product label and, when in doubt, consult your local cooperative extension service. We provide the app "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for damage to your lawn, plants, pets, property, or person resulting from the use of any product we recommend.

3. Free tier, free trial, and paid subscription

Free tier: 5 lifetime diagnoses. After that you must start a free trial or subscribe to continue diagnosing.
Free trial: 7 days of unlimited diagnoses. We do not require a payment method to start the trial. The trial ends automatically after 7 days; you keep access to any history saved on your device.
Paid subscription: $29 per year for unlimited diagnoses and full history. Subscriptions auto-renew annually unless you cancel before the renewal date. You can cancel at any time; cancellation takes effect at the end of the current billing period.
Refunds: Except where required by law, fees are non-refundable. If you bought through a third-party app store, refund requests must go through that store's process.
Price changes: We may change subscription prices with at least 30 days' notice before your next renewal.

4. Amazon affiliate links

Product recommendations include affiliate links to Amazon. As an Amazon Associate we earn from qualifying purchases. This does not change the price you pay. See our Privacy Policy for more.

5. Acceptable use

You agree not to:

Use the app for anything illegal or harmful
Upload photos that contain other people's faces, license plates, or content you do not have rights to share
Try to reverse engineer, scrape, overload, or interfere with the app or its servers
Resell, white-label, or redistribute diagnoses without our written permission

We may rate-limit, suspend, or terminate accounts that violate these rules.

6. Your content

You keep ownership of the photos you upload. You grant us a limited, worldwide, royalty-free license to process them solely to provide a diagnosis to you and operate the app. We do not use your photos to train AI models.

7. Third-party services

The app uses third-party services (for example, our AI provider, payment processor, and Amazon's affiliate program). Your use of those services is also governed by their terms and privacy policies.

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the app is limited to the amount you paid us in the 12 months before the claim, or USD $50 if you have not paid us anything.

9. Changes

We may update these Terms from time to time. We will revise the "Last updated" date and notify you of material changes inside the app. Continuing to use the app after changes take effect means you accept the new Terms.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless your local consumer law requires otherwise.
